Terms of Sale (CGV)
📋 Preamble & Seller Identification
These General Terms and Conditions of Sale (hereinafter “Terms”) govern the contractual relationship between the Seller and any individual or entity (hereinafter “the Customer” or “the Buyer”) purchasing the digital publication offered on the website nighthopebangkok.com.
The Seller is identified as follows:
Any order placed on the website implies the Customer's prior, full, and unconditional acceptance of these Terms.
🎯 Article 1 – Purpose
These Terms govern the online sale of intangible, digital content provided by the Seller on the website nighthopebangkok.com.
📖 Article 2 – Description of Digital Products
The product offered for sale is an electronic, downloadable publication (e-book) entitled “NightHope Bangkok — The Protocol”, authored by Marc SAVIGNON.
Purchase grants instant access to download the publication in two complementary digital formats:
- High-Definition PDF: Complete 43-page visual book layout with clickable navigation, action cards, and responsive reading capability on desktops, tablets, and smartphones.
- Standard ePub 3 Format: Optimized for e-readers (Amazon Kindle, Kobo, Apple Books, Google Play Books).
No Physical Goods: This product is exclusively intangible. No physical package, printed book, or hard storage medium is delivered.
💰 Article 3 – Price & Payment Terms
3.1 Pricing
The purchase price for the digital publication is set at $49.00 USD (or €49.00 EUR).
The Seller reserves the right to modify prices at any time. However, products will always be billed based on rates in effect at the time the order is confirmed by the Customer.
As a registered French micro-enterprise, the Seller operates under the VAT exemption regime pursuant to Article 293 B of the French General Tax Code (CGI). VAT is not applicable. The price displayed is the total net amount due.
3.2 Secure Online Payment
Payment is made in full at checkout via credit/debit card (Visa, MasterCard, American Express) through our secure payment processor Stripe.
All transactions are encrypted end-to-end under TLS/SSL protocols and comply with strict PCI-DSS Level 1 security standards. The Seller never has access to the Customer's payment card numbers. Charges are debited immediately upon transaction confirmation.
⚡ Article 4 – Ordering & Immediate Delivery
The ordering procedure consists of the following steps:
- The Customer clicks the purchase button on the website.
- The Customer enters personal details (name, email) and completes secure payment via Stripe.
- Upon payment authorization by Stripe, the order is confirmed as final and binding.
Immediate Fulfillment: Delivery is executed immediately:
- Via automatic redirection to the secure confirmation page allowing instant download of both PDF and ePub files.
- Via simultaneous automated delivery of a purchase receipt and permanent download links sent to the Customer's email address.
↩️ Article 5 – Right of Withdrawal & Express Waiver
Express Waiver Clause (EU Directive 2011/83/EU & Article L221-28 13° of the French Consumer Code):
Under statutory consumer protection rules for distance contracts, the statutory 14-day cooling-off / withdrawal period does not apply to contracts for:
“The supply of digital content not provided on a tangible medium where the performance has begun with the consumer’s prior express consent and their acknowledgment that they thereby lose their right of withdrawal.”
By completing the purchase in order to obtain immediate download access to the digital book, the Customer expressly consents to the immediate execution of the contract and expressly waives their right of withdrawal. Consequently, no refund can be granted once the download links or digital files have been delivered.
©️ Article 6 – Intellectual Property & License to Use
All contents within “NightHope Bangkok — The Protocol” (texts, methods, frameworks, layout, illustrations, logos) are protected by international copyright laws and remain the exclusive property of Marc SAVIGNON.
Purchase grants the Customer a personal, single-user, non-exclusive, and non-transferable license for strictly private use.
Strictly prohibited without prior written authorization from the author:
- Any copying, reproduction, translation, or alteration of any part of the publication;
- Any public dissemination, uploading to torrents, peer-to-peer networks (P2P), Telegram channels, Discord servers, or public repositories;
- Any commercial resale, redistribution, or unauthorized sublicensing.
🛡️ Article 7 – Mental Health Disclaimer & Limitation of Liability
“NightHope Bangkok — The Protocol” shares personal lived experiences and an empirical roadmap for emotional and psychological electroshock. It does not constitute medical advice, psychological counseling, or psychiatric treatment.
In situations of acute emotional distress, depression, or suicidal ideation, the Customer is urged to contact professional healthcare providers or national emergency hotlines immediately (e.g. 988 in the United States and Canada, 111 in the United Kingdom, 3114 in France).
The Customer remains solely responsible for their personal decisions, travels, finances, health, and compliance with the laws of countries visited.
🔒 Article 8 – Protection of Personal Data (GDPR)
Personal information collected during order fulfillment is processed in accordance with the European General Data Protection Regulation (GDPR). For full details regarding data retention and rights of access, please read our Privacy Policy.
⚖️ Article 9 – Governing Law & Dispute Resolution
These Terms of Sale and all resulting purchase transactions are governed by and construed in accordance with French law.
In the event of a dispute, an amicable solution shall be sought in priority by contacting the Seller at contact@nighthopebangkok.com. Failing amicable resolution, any litigation shall fall under the exclusive jurisdiction of the competent courts of Romans-sur-Isère (France).
